Terms of Service

1. Acceptance of Terms
By using eshucustoms.com or placing an order with ESHU ("ESHU", "we", "us"), you agree to these Terms of Service. If you do not agree, please do not use the site or place an order.
2. About ESHU & AIMS
ESHU designs, prints, and delivers custom apparel across the UAE and Kenya. AIMS is ESHU's own internal marketing and content operations system — it is used by ESHU to plan and publish ESHU's marketing content, and is not a service offered to customers or the public.
3. Using Our Website & Placing Orders
You agree to provide accurate order and contact information, and to use the site only for lawful purposes. Order confirmation, pricing, and delivery timelines are as shown at checkout and in your order confirmation. We reserve the right to decline or cancel an order (for example, for suspected fraud, an unprintable file, or a stock issue), in which case any payment already taken will be refunded.
4. Your Artwork & Content
When you upload artwork, a design, or other content for printing, you confirm that you own it or have the right to use and reproduce it, and you grant ESHU a limited license to reproduce it solely to fulfil your order. You are responsible for ensuring your content does not infringe any third party's intellectual property, trademark, or other rights, and you agree to indemnify ESHU against claims arising from content you supply.
5. AI-Generated Content
AIMS may use AI tools to help ESHU draft marketing captions, creative concepts, or design variations for ESHU's own campaigns. AI-assisted output used in ESHU's marketing is reviewed by ESHU staff before publication. This does not apply to customer-supplied artwork, which is printed as provided.
6. Third-Party Integrations
The site and ESHU's marketing operations rely on third-party services, including Stripe for payment processing and, optionally, TikTok for ESHU's own social media account. Use of these services is also subject to each provider's own terms.
7. TikTok Integration
Connecting ESHU's TikTok account to AIMS is optional and is performed only by authorized ESHU staff. AIMS accesses only the TikTok permissions ESHU has requested and TikTok has granted for ESHU's own account (see our Privacy Policy for the exact list). This authorization can be revoked by ESHU at any time from within TikTok. AIMS may, once this capability is built, transfer operator-approved content to TikTok as a private draft for staff review — draft upload does not mean automatic public posting, and ESHU has not enabled TikTok's Direct Post capability.
8. Service Availability
We aim to keep the website available and orders processing smoothly, but we do not guarantee uninterrupted or error-free service, and the site or specific features (including any AI-assisted or social-platform integration) may be unavailable from time to time for maintenance or reasons outside our control.
9. Account Authorization & Revocation
Access to ESHU's administrative tools and third-party integrations (including TikTok) is limited to authorized ESHU staff and can be revoked by ESHU at any time. Revoking an integration stops AIMS from acting on that platform going forward; it does not retroactively undo actions already taken while the authorization was active.
10. Limitations
To the fullest extent permitted by law, ESHU is not liable for indirect, incidental, or consequential damages arising from your use of the site or from any third-party service (including TikTok) that ESHU integrates with. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Governing Law & Business Information
These Terms are governed by the laws applicable to ESHU's place of business in the United Arab Emirates. ESHU can be reached at Dubai, United Arab Emirates.
12. Changes to These Terms
We may update these Terms from time to time — for example, as AIMS's TikTok integration is extended. Material changes will be reflected by updating the "Last updated" date above.
